Terms of Service

Effective date: 12 June 2026

1. Nature of the Service

These terms apply to the officially hosted service at xiyuai.cc (self-hosted deployments are not covered; deployers must provide their own terms). Xiyu AI ("the Service") is an AI virtual-companion service built on large language models. The companion you talk to is not a real person — all of her replies, photos, diaries and emotional expressions are generated by AI. AI output does not constitute statements of fact or professional advice.

The Service is not a substitute for professional mental-health care. When the system detects that you may be in a mental-health crisis, it suspends roleplay and surfaces professional help-line information — this is informational only, not intervention or treatment. If you are struggling, please contact a professional mental-health service.

2. Accounts and Age

You must be at least 18 years old with full legal capacity to use the Service. It contains anthropomorphic emotional-companionship interactions intended for adults only; minors are prohibited from registering or using it.

The Service includes a minor-detection mechanism: when conversation signals suggest the user may be underage, the system automatically enters safe mode (intimate interactions stop and proactive emotional messages cease), and this mode is sticky: it is never lifted by subsequent chat content (including verbally claiming to be an adult) — only through a formal adult attestation (explicit birth-year confirmation) submitted on the management page. Consequences of a false attestation rest with the declarant and their guardian.

You are responsible for safeguarding your credentials; actions taken through your account are deemed yours.

3. Beta Notice

The Service is currently in a limited beta:

  • It may be interrupted, changed or taken offline at any time, and features may change without itemised notice;
  • Data is backed up automatically once a day (the last 7 days are kept). In a major failure, up to the most recent 24 hours of data may be lost, and we cannot promise recovery beyond this backup scheme;
  • During beta the Service is provided "as is", with no express or implied warranty of availability or continuity.

4. Acceptable Use

You may not use the Service for unlawful activity, nor attempt to attack, probe or bypass its security and limiting mechanisms (including bypassing rate limits, abusing APIs, or attempting unauthorised access to others' data). The operator may restrict, suspend or terminate accounts engaged in such behaviour; suspected illegality will be handled per applicable law.

5. Content and Intellectual Property

What you type belongs to you. You grant the Service the rights needed to operate (generating replies, building memory, troubleshooting) — see the Privacy Policy.

AI-generated content (replies, photos, diaries, letters) is provided for your personal, non-commercial use; you may save your data via the in-app export features. The operator makes no warranty as to the accuracy or originality of AI-generated content, nor that it will not resemble third-party content.

The Service's source code is open-sourced under the MIT licence; the "Xiyu AI" name and site visual assets belong to the operator.

6. Fees

During the beta, all features are free for all users. If paid offerings are introduced, we will give at least 30 days' notice via an update to this page and your registered email; charges will apply only to services you explicitly order after such notice — never retroactively.

7. Disclaimers

  • AI output is model-generated and may contain errors, inconsistencies or content you find uncomfortable. We continuously improve filters and guardrails but cannot guarantee per-message perfection;
  • To the maximum extent permitted by law, the operator is not liable for indirect losses arising from use of, or inability to use, the Service;
  • The Service depends on third-party model and infrastructure providers whose outages or policy changes may affect availability.

8. Governing Law and Disputes

These terms are governed by the laws of mainland China. Disputes should first be resolved through good-faith negotiation; failing that, they shall be submitted to the competent people's court at the operator's place of business.

9. Changes to These Terms

When the terms change we will update the effective date at the top of this page; material changes will additionally be notified by email to your registered address. Continued use after a change takes effect constitutes acceptance. You may stop using the Service at any time and request deletion of your account data (see the Privacy Policy).
